Since the 1980s, California has led the nation in the number of people incarcerated. After decades of overcrowding a lawsuit forced the state to reduce its prison population, which led not only to the release of many low level prisoners, but a change in the decision-making process for incarceration, as well as plans to reduce recidivism. Last year, Prop 47 was passed by voters, which changed the categorization and reduced criminal penalties and sentences for many nonviolent crimes. The law made the new sentencing retroactive qualifying many for release, as well as allowed for the records of those who had already served their time to be changed accordingly. The incarceration rate has been declining steadily in the state since 2008, which has removed California from the number one spot.
